Think I might of found it 476324e8ba441a4f364787c7a8b0037f1687dca5 ntdll: Compute the free lists address at run-time instead of playing with alignment and padding I'm gonna reset to the latest git with the patch reverted to see if it works.

Some code was added to wine in 1.1.22 to reserve additional uniforms which reduced the max some shaders use to around 245 I think, EVE needs like 247-248 to play on high shader settings with wine.

The patch was actually made by KeithG, however I'm not 100% which ATI cards need the uniforms and varying changes (none of the nvidia cards should need them). The 1024, 1024, 52 is based off the latest released cards by AMD (the hd4800 series) so ...

It's working on my hd4850 now , I was trying to change the MAX_CONST defines in dlls/wined3d/wined3d_private.h, but wine would crash as soon as my ship rendered. I guess other equations needed those high values
